Three fined $3,000 for causing injury

Two men and one woman were each fined $3,000 to be paid in six months or in default to six months in prison when they appeared for sentencing at the Roseau High Court before trial judge Justice Birnie Stephenson on Monday November 25, 2013.

In all three cases the defendants were found guilty on a second charge which carries maximum two years imprisonment, but not guilty on the more serious offence of causing grievous bodily harm with intent.

Justice Stephenson had all three convicted persons, Erwin Jamal George of Roseau, Shermel Christopher of Marigot and Kennon Samuel of Giraudel, in the prisoners' dock as she examined the facts and circumstances of the cases, the mitigating and aggravating factors as well as the principles of sentencing such as deterrence, retribution, restoration and rehabilitation.

In the case of Erwin Jamal George, a jury had on Thursday October 10, after a six-day trial found him guilty of inflicting grievous bodily harm on his former girlfriend Kim Peterson of Canefield. Acting Director of Public Prosecutions Levi Peter and State Attorney Sherma Dalrymple prosecuted the case for the state during which they called eight witnesses while Wayne Norde defended George.

In the Shermel Christopher of Marigot incident, the jury found her guilty of unlawfully and maliciously inflicting grievous bodily harm on Kafie Ferreira with intent to do grievous bodily harm on Monday October 14, 2013 at the end of a two-day trial.

Acting DPP Levi Peter called four witnesses on behalf of the State. David Bruney defended Christopher.

In the third case, State Attorney Sherma Dalrymple assisted by State Attorney Arthlyn Nesty called five witnesses on Thursday October 31, 2013 to prove the charge of unlawful and malicious wounding by Kennon Samuel on the person of Giael Registe before a jury of six men and three women. David Bruney was counsel for the accused.

In each case, the virtual complainant will seek compensation.
